Welcome to the www.shaikhascloset.com and www.shaikhasluxurycloset.com , the websites (the “Site”) of SHAIKHA’S CLOSET, covering all registered domain endings, such as “.com”. Shaikha’s Closet provides its terms and conditions (“T&Cs”) to the clients, visitors, users, sellers, and any other users as detailed below.
Luxury Avenues for Clothing Trading LLC is the legal entity behind Shaikha’s Closet websites (Shaikasluxurycloset.com and Shaikhascloset.com). For the purposes of this contract “Luxury Avenues for Clothing Trading LLC” will be referred to as “Shaikha’s Closet”. Shaikha’s Closet is committed to protecting the privacy of all Users.
By using our Site/Sites, Application and Services; you explicitly confirm that you are either at least 18 years of age or are accessing the Site and its services under the supervision of a parent or legal guardian.
Before you may use the Site/Sites, you must read and accept all the terms and conditions in, and linked to, this Terms and Conditions statement (“T&Cs”) and the Privacy Policy on our website. These T&Cs are effective upon acceptance. Use of any functionality of the Site, makes you a user (“User”) and constitutes your acceptance of these T&Cs and all applicable laws. These T&Cs apply for Guest Checkout as well even if done without the creation of a User account. If these T&Cs conflict with any other documents, the T&Cs will control for the purposes of usage of the Site.
Usage of the Site (whether clients, visitors, users or sellers, etc.) is subject to your explicit agreement to our T&Cs and being bound to the same. If you do not agree to these T&Cs, you may not use the Site at all and in anyway or form.
General Terms
If any of these conditions is deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
From time to time Shaikha’s Closet may offer special promotional offers, which may or may not apply to your Shaikha’s Closet account. You agree to be bound by any additional terms and conditions for these special offers.
Headings are for reference purposes only and do not limit the scope or extent of such section. The laws of the United Arab Emirates will govern these T&Cs and the relationship between you and Shaikha’s Closet.
The failure of Shaikha’s Closet to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Shaikha’s Closet does not guarantee it will act against all breaches of these T&Cs. Except as otherwise expressly provided in these T&Cs, there shall be no third-party beneficiaries to these T&Cs. These T&Cs constitutes the entire agreement between you and Shaikha’s Closet and governs your use of the Site, superseding any prior agreements between you and Shaikha’s Closet with respect to the Site.
Country of Domicile
Shaikha’s Closet and the associated Site/Sites, the to be launched application and any intellectual property are owned and represented by Luxury Avenues Trading LLC with its registered office and place of business at Abu Dhabi, Baynouna Tower, PO Box 221, Abu Dhabi, United Arab Emirates (“UAE”).
Laws and Jurisdiction
These T&Cs are governed by, and construed in accordance with, UAE law.

TERMS OF SERVICES OFFERED
Description of Services
In the site, Shaikha’s Closet provides users with access to sales of fashion and luxury products and services online & offline when required (the “service”). You are responsible for obtaining access to the site, and that access may involve third-party fees (such as internet service provider or data usage charges). In addition, you must provide and be responsible for all equipment necessary to access the Site and maintain your access.
License and Site Access
Shaikha’s Closet grants you limited license to access and make personal use of the Site/Sites and the Service. This license does not include any downloading or copying of account information for the benefit of another vendor or any other third party; caching, unauthorized hypertext links to the Site and the framing of any content available through the Site/Sites uploading, posting, or transmitting any content that you do not have a right to make available (such as the intellectual property of another party); uploading, posting, or transmitting any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; any action that imposes or may impose (in Shaikha’s Closet’s sole discretion) an unreasonable or disproportionately large load on Shaikha’s Closet’s infrastructure; or any use of data mining, robots, or similar data gathering and extraction tools. You may not bypass any measures used by Shaikha’s Closet to prevent or restrict access to the Site. Any unauthorized use by you shall terminate the permission or license granted to you by Shaikha’s Closet.
Account Registration
In consideration of your use of the Site, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United Arab Emirates or any other applicable jurisdiction. You also agree to provide true, accurate and complete information about yourself as prompted by the Site’s/Sites’ registration form. If you provide any information that is untrue, inaccurate, or incomplete (or becomes untrue, inaccurate or incomplete), or Shaikha’s Closet has reasonable grounds to suspect that such information is untrue, inaccurate or incomplete, Shaikha’s closet has the right to suspend or terminate your account and refuse any and all current or future use of the Site/Sites (or any portion thereof). Upon usage of the Site/Sites, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. Due to the previously mentioned, we strongly recommend that you exit from your account at the end of each session. You agree to notify Shaikha’s Closet immediately of any unauthorized use of your account or any other breach of security. Shaikha’s Closet reserves the right to refuse service, terminate your account or accounts, or remove or edit content at its sole discretion.
Limitation of liability
You expressly understand and agree that Shaikha’s Closet and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, inaccurate pricing due to human error, technical error or bug, software
glitches or other unforeseen circumstances that might lead to any direct or indirect damage, damages for loss of profits, goodwill, use, data or other intangible losses (even if Shaikha’s Closet has been advised of the possibility of such damages), resulting from use of the site, content or any related services.
Indemnity
You agree to indemnify and hold Shaikha’s Closet (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys’ fees, cost of litigation or any other costs arising out of or related to your breach of these T&Cs, or your violation of any law or the rights of a third party.
Any dispute or claim arising out of or in connection with this site shall be governed and construed in accordance with the laws of the United Arab Emirates.
Payment Methods
We accept payments via Visa and MasterCard credit/debit cards, Cash on Delivery, PayPal and Bank Transfers. Cash on Delivery payment option is available for deliveries in UAE only (our home market) with limitations (not applicable to items made from Exotic skins, Jewellery, Final Sale items and other non-refundable items).
Electronic Communication
Upon usage of the Site/Sites or sending emails to Shaikha’s Closet, you are communicating with Shaikha’s Closet electronically. You consent to receive communications from Shaikha’s Closet electronically. Shaikha’s Closet will communicate with you by email or by posting notices on the Site/Sites or sending emails to Shaikha’s Closet, you are communicating with Shaikha’s where feasible. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Site-Provided Email and Postings
The Site/Sites may provide users with the ability to send email messages to other users and non-users and to post messages on the Site/Sites. Shaikha’s Closet is under no obligation to review any messages, information or content (“Postings”) posted on the Site/Sites by users and assumes no responsibility or liability relating to any such Postings. Notwithstanding the above, Shaikha’s Closet may from time to time monitor the Postings on the Site/Sites and may decline to accept and/or remove any email or Postings. You understand and agree not to use any functionality provided by the Site/Sites to post content or initiate communications that contain:
— Any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law.
Links
The Site/Sites or third parties may provide links to other World Wide Web sites or resources. Due to lack of control over such sites or resources, you acknowledge and agree that Shaikha’s Closet is not responsible for the availability of such external sites or resources, and does not endorse or is responsible or liable for any content, advertising, products or other materials on or available from such sites or resources.
You further acknowledge and agree that Shaikha’s Closet shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
Access to Password Protected/Secure Areas
Access to and use of password protected and/or secure areas of the Site/Sites is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Site/Sites may be subject to prosecution.
Minors under the age of 18 shall are prohibited from registering as a user of this Site/Sites and are not allowed to transact or use the Site/Sites.
Modification and Notification of Changes
Shaikha’s Closet reserves the right to make changes to the Site/Sites, related policies and agreements, these T&Cs and the Privacy Policy at any time. If Shaikha’s Closet makes a material modification to this TOS, it will notify you by sending an email to the address associated with your account. Shaikha’s Closet is not responsible for your failure to receive an email due to the actions of your ISP or any email filtering service; therefore, you should add Shaikha’s closet to the list of domains approved to send you email (commonly known as your “whitelist”).
Trademarks
The trademarks, logos and service marks (“Marks”) displayed on the Site/Sites are the property of Shaikha’s Closet and other parties. Users are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or sites on the World Wide Web without the written permission of Shaikha’s Closet or such third party which may own the Marks. All information and content including any software programs available on or through the Site (“Content”) is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any content available on or through the Site/Sites for commercial or public purposes.
Shaikha’s Closet is not associated with the brands that it sells which are owned by the respective brand owners.
Survival of Terms After Agreement Ends
Notwithstanding any other provisions of these T&Cs, or any general legal principles to the contrary, any provision of these T&Cs that imposes or contemplates continuing obligations on a party will survive the expiration or termination of these T&Cs.
Buying Terms
This section constitutes a binding agreement between User (hereafter within these Buying Terms “Buyer”) and Shaikha’s Closet. We highlight the point that that Shaikha’s Closet is not associated in any way with the brands it sells on the Site.
Buyer wishes to purchase certain items (“Item”) as may be displayed and described on our Site/Sites. It is at Shaikha’s Closet sole discretion to display or remove the displayed item depending on its availability or non-availability or any other reason that appears valid to Shaikha’s Closet. Shaikha’s Closet is not liable to inform or alert the Buyer before removing or adding such an item.
Shaikha’s Closet wishes to sell the Item either on behalf of a Seller or the organization, subject to Buyer agreeing the following Buying terms and TOS:
1. Buyer acknowledges that Brands mentioned on the Site/Sites are not involved in the authentication of Item being sold and none of the brands owners or Sellers assumes or own any responsibility for any Item purchased through the Site. Shaikha’s Closet’s authentication process is in-house and independent of any brand association of any kind or nature.
2. Buyer should note that descriptions of Item or Items are not warranties and that each Item is sold on “as is” basis. Measurements are approximate and descriptions are based on Shaikha’s Closet’s judgement. The items sold are mostly secondhand items and are expected to have displays or use such as scuffs, scratches, marks on the interior or exterior, discoloration, etc.
3. The methods of payment for a purchased Item as accepted by Shaikha’s Closet are as follows:
A. Debit Cards
B. Credit Cards
C. PayPal
D. Cash-On-Delivery within the UAE
E. Bank Transfers
F. Other third-party payment services if available.
The Buyer acknowledges that the availability or non-availability of certain payment methods is at Shaikha’s Closet’s sole discretion.
Product Descriptions
Shaikha’s Closet strives to be as accurate as possible. However, Shaikha’s Closet does not warrant that product names, descriptions, titles, attributes, specifications, price or other content or any other information related to the product(s) is accurate, complete, reliable, current, or error-free.
Shaikha’s Closet holds ownership in the way the content is displayed on its website and any other promotional materials.
Pricing
Estimated Retail Price
The “estimated retail price” is an estimate/ guess/ judgement based on research from the brand’s main site or other competitive sites in the region and around the world. The buyer agrees that Shaikha’s Closet in its sole discretion will determine the initial estimated selling price for the item (the “Estimated Retail Price”), based on its evaluation of the item along with its determination of the current market price for each specific item within the store (electronic and physical if any).
Shaikha’s Closet Price
“Shaikha’s Closet Price” means the decided selling price of a product which is a result of a bidding contractual agreement between the Seller and Shaikha’s Closet or Shaikha’s Closet’s own judgement in the case where the item or items being sold are owned by the organization. We regularly check estimated retail prices against prices recently found on Shaikha’s Closet and other retailers. Certain products may have a “Was Price” displayed when the item goes on sale, which is determined using recent price history of the product on Shaikha’s Closet.
With respect to items on sale on Shaikha’s Closet, we cannot warrant the price of an item until your order is confirmed by us. Despite our best efforts, a limited number of the items in our catalog may be mispriced. If the correct price of an item sold is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation and the refund thereof.
Shaikha’s Closet is not liable to contract with the customer for any item that is priced incorrectly.
Delivery:
Shaikha’s Closet generally does not confirm and ship the order until after we have received approvals from our third-party partner authentication services who verifies your credit card details and account.
Shaikha’s Closet is not liable for delays in order deliveries because of custom clearances at destination or out of control delays from our third-party delivery partners.
Shaikha’s closet does not deal with any sanctioned countries, organizations or individuals in accordance with the law of the UAE. Regulations may prohibit importation of items made with exotic materials (e.g. crocodile skin) to certain countries.
Returns:
Buyer is liable and responsible to read specific return terms and conditions and other policies related to returns in Shaikha’s Closet prior to placing or initiating a return about the refund policies.
Most purchased Items can be returned for a refund of the purchase price (“Shaikha’s Closet Price”) provided that:
A. Buyer is required to express a wish to return and is obligated to inform Shaikha’s Closet about returns made or to be made or to initiate a return. Contact Shaikha’s Closet via email or phone as per the details of contact on the website. Please note that such details could be changed / updated at the discretion of Shaikha’s Closet without prior notice to the clients.
B. Returns are not available for buyers outside the UAE. All sales to clients outside the UAE are considered final sales.
C. Within the UAE, item should be returned undamaged in the original condition as it was received, with Shaikha’s Closet packaging including; original papers, original packaging, authentication cards & invoices, and tags still attached.
D. Returns are not available for Jewellery or items made from exotic skins regardless of the purchase location (within the UAE or international sales).
E. Item must be shipped within 1 day of Buyer’s receipt of the Item.
F. Item reaches Shaikha’s Closet office in Abu Dhabi within 3 days of the Buyer’s receipt of the item.
G. Within 7 business days upon receipt of your returned merchandise, we will issue a refund to you. If you paid by cash or Bank Transfer, we will refund you through a bank transfer. If you paid with a credit card or PayPal, we will issue a refund to the same card.
H. Refund price includes only the cost of the item, and does not include any shipping fee paid, or custom duties. Any conversion or other fees paid by buyer on the card transaction to the card company are not refunded by Shaikha’s Closet.
I. Items that are marked as ‘No returns on this item’ are final sale items. Once purchased, such items cannot be returned.
Warranty
Shaikha’s Closet does not warrant, represent or undertake as to the quality of the goods and items sold.
In the event of the sale of an inauthentic item, Shaikha’s Closet will issue a 100% refund, including the cost of return shipping.
Value Added Tax (VAT):
United Arab Emirates (UAE) has implemented VAT starting 1 January 2018. With a standard rate of 5%, VAT will apply to most of the supplies of goods and services supplied through the site.
All prices shown on the Shaikha’s Closet website are inclusive of VAT for customers from the UAE. The exact VAT applicable to your order will be calculated upon checkout based on the selected delivery destination. In addition, for orders delivered outside the UAE local import taxes may be applied to your order and these will be shown at checkout.
Custom Duties / Taxes:
Shaikha’s Closet items are shipped from Abu Dhabi, UAE. Almost all countries apply custom duties on import of items. The Buyer is liable and will be required to pay the customs duty upon delivery of the products. Buyer is liable to check duty rates for your country prior to making the decision of purchase.
Authenticity:
Shaikha’s Closet certifies that all products sold on its platform are 100% authentic and offers a money back guarantee for the products.
Restrictions:
Based on the country specific regulations, we may be prohibited from shipping items made with exotic materials.
Payment Methods:
Shaikha’s Closet provides all possible payment options for our customer’s convenience. Cash on delivery (COD), debit & credit cards, bank transfers, PayPal and third-party payment services. Some payment methods might be unavailable for specific destination countries, specific products or customers.
Cash on delivery (COD) is only available within the UAE.
In certain cases, for payments made via Credit Card, we might get in touch with you to request for additional personal documents, such as a passport copy or ID card, in order to confirm your order. This is required to verify the identity of the buyer and safeguard the cardholder against any possibility of fraudulent payments.
Shaikha’s Closet has the right to suspend or terminate the payment options available on your account and refuse any or all current or future use of the payment options available on the site (or any portion thereof).
Shaikha’s closet is not liable or bound to inform or send specific communication to the user regarding the changes on the website (or any portion thereof). The customer is responsible to get in touch with Shaikha’s Closet in order to get the payment options reactivated.
Promotions and Codes:
Shaikha’s Closet might offer promotional discounts through promo codes/ vouchers /coupons or other means / methods. The follow conditions apply to the use of such promotions:
1. Buyer can only redeem one promotion/ coupon/ voucher code at a time; per transaction.
2. Validity and offer of the coupon/ voucher/ promotion code applicable per transaction is dependent on the T&Cs published on the promotion banner or voucher.
3. Shaikha’s Closet reserves rights to withdraw any promotional coupon code without any prior intimation to the buyer.
4. Shaikha’s Closet would at times conduct social media competitions. Winners to such competitions are randomly selected. Shaikha’s Closet reserves rights to not disclose the details of participants to the competition.
5. The results of such above mentioned competitions and contests will not be discussed by Shaikha’s Closet. Shaikha’s Closet holds and maintains the rights to not disclose any such information. The participants to such competitions have no rights to contest or question the results in anyway.
SELLING TO SHAIKHA’S CLOSET:
Shaikha’s Closet offers its clients 2 ways for selling their items, whether used or new. Shaikha’s Closet maintains the right to decline selling or consignment offers at its sole discretion. This could be due to market factors, condition of the items, or any other factor. Once items are assessed, the clients have an option of either selling to Shaikha’s Closet based on an assessment that is agreed upon prior to finalizing the sale or consigning with Shaikha’s Closet based on a range of pricing that is estimated at the beginning of the process. For the consignment service, Shaikha’s Closet charges a nominal commission fee based on 20% flat rate with a minimum of AED 200.
Pricing
Selling to Shaikha’s Closet
Clients offered the instant sale option, who opt to the selling option will be paid within 5-10 business days from the agreement date. Clients should note that the pricing of the items is based on the following factors:
— Verification of the items’ authenticity.
— Condition of the item (wear and tear, discoloration, stains, cuts, etc.).
— Prevalence of the item.
— Popularity of the item.
— Availability of the inclusions (papers & authenticity cards, dust bags, boxes, etc.).
Offers are not provided before inspecting the item in Shaikha’s Closet premises. We apply very rigorous standards in the inspection process to ensure that the item received is authentic. We will provide estimated payout ranges to the client, if required, before sending the item for a full-fledged inspection, however, we are not obliged nor liable to meeting or applying the initial estimated payout ranges.
The seller is responsible for the legal ownership of the item. The Seller warrants to Shaikha’s Closet that the item being sold or consigned has been obtained in a lawful manner and is possessed legally with no challenges from other parties whatsoever. Shaikha’s Closet will assume that the seller has acquired the item in a lawful manner and will not be responsible for any unlawful actions on the seller’s side or any third party’s side. Shaikha’s Closet will request additional documentation to prove ownership of the item at its sole discretion.
The seller is required to supply Shaikha’s Closet with a valid bank account number with details such as bank name, swift code, IBAN and any other relevant information. Shaikha’s Closet will bear its share of the banking fees charged by its bank, however, any charges or currency fluctuations, transfer receipt fees on the seller’s side will not be borne by Shaikha’s Closet. For more information on that, please check with your bank. In cases where the payment has been denied once, the cost of the transfer will be deducted from the payout prior to second transfer.
In cases where an agreement could not be reached on the pricing, Shaikha’s Closet maintains the right to charge the seller an authentication fee, delivery fees and any other incurred fees.
Consigning with Shaikha’s Closet:
Shaikha’s Closet will provide the Consignor (seller) with an initial pricing range based on the pictures and details received prior to the inspection of the item. Shaikha’s Closet will also provide an estimate of the commission charged based on the 20% rate with a minimum of AED 200. Once the items are received on site, authenticated and assessed, a final pricing range is provided to the clients.
The Consignor (client) agrees to ship the items to Shaikha’s Closet premises for inspection and a final assessment of the items.
Final offers are not provided before inspecting the item in Shaikha’s Closet premises. We apply very rigorous standards in the inspection process to ensure that the item received is authentic. We will provide estimated payout ranges to the client, if required, before sending the item for a full-fledged inspection, however, we are not obliged nor liable to meeting the initial estimated payout ranges.
Clients should note that the pricing of the items is based on the following factors:

— Popularity of the item.
— Availability of the inclusions (papers & authenticity cards, dust bags, boxes, etc.).
Value Added Tax (VAT):
The Gulf Cooperation Council (GCC) of which the UAE and Kingdom of Saudi Arabia are member states along with Qatar, Kuwait, Bahrain, and Oman will have VAT implementation at a standard rate of 5% and 15% for KSA. Since the 1 January 2018, businesses/ individuals in the United Arab Emirates (UAE), Kingdom of Saudi Arabia (KSA) and other GCC countries are required to comply with VAT rules and obligations. Charging of VAT, issuing tax invoices, filing periodical VAT returns and paying of VAT if any due to the tax authorities. The VAT rate was increased in KSA to 15% effective July 1st, 2020.
Shaikha’s Closet will comply to the rules and obligations for VAT set by the Governments of all jurisdictions we do business in and will calculate the VAT % as per what the Legislation specifies and the conditions that are to be met in order to apply the mechanism of sale of second hand goods.
Shaikha’s Closet has the right to issue to you, the Seller purchase invoices on your behalf with details not limited to and inclusive of your name, company, trade name details, address, your payout as per agreement, commissions and VAT incurred. Registering and complying to VAT law is the sole responsibility of the Seller. Seller is required and responsible to communicate TRN details, Tax invoice in compliance with VAT Decree-Law and Executive regulations.
The payout as per agreement amount refers to the amount payable to you in respect of the goods and will be exclusive of VAT. Shaikha’s Closet is not liable to pay the Seller the VAT amounts and has the right to hold the payout(s) that may be due to the Seller’s non-compliance and defection as per the VAT Decree- Law applicable in the jurisdiction of business and shipping.
Shaikha’s Closet is not liable for any defect, non-compliance, non-payment that is limited or not limited to VAT and due on the Seller’s side for the items purchased by Shaikha’s closet.
The Consignor (Client) should note that the prices displayed on the website or any associated platform of choice are inclusive of VAT and will not be the basis to the payout calculations.
Consignment Period:
Shaikha’s Closet provides a 90 days lock-in consignment period for sellers based in the UAE and 180 days lock-in consignment period for sellers outside of the UAE.
Commission Structure:
Shaikha’s Closet charges commission depending on the selling price of an item. The commission is the fees that Shaikha’s Closet charges to process, hold and showcase Seller item(s) on our Site/Sites. The commission structure cannot be contested or questioned. By consigning with us, Consignor (client) is considered to acknowledge and agree to the commission that is due to Shaikha’s Closet.
The commission charged is 20% of the selling price (net of VAT) with a minimum of AED 200.
Shaikha’s Closet maintains the right to change the commission charged at any given time without informing the client. It is the responsibility of the client to review the terms and conditions, and any updates to it hereafter.
Payment to Consignor (client):
Shaikha’s Closet agrees to pay proceeds from the sale of the consigned merchandise within eight to ten (8-10) business days of receipt by the buyer. Payment is processed through bank transfers only.
The Consignor (client) is required to supply Shaikha’s Closet with a valid bank account number with details such as bank name, swift code, IBAN and any other relevant information. Shaikha’s Closet will bear its share of the banking fees charged by its bank, however, any charges or currency fluctuations, transfer receipt fees on the Consignor’s (client) side will not be borne by Shaikha’s Closet. For more information on that, please check with your bank. In cases where the payment has been denied once, the cost of the transfer will be deducted from the payout prior to second transfer.
Price Reduction:
Shaikha’s Closet is authorized to reduce the pricing to the lower range provided to the consignor at the agreement stage without informing the Consignor. Shaikha’s Closet will exercise its commercial acumen and market knowledge to improve the chances of selling the item / items within the lock-up period within the ranges provided in the agreement.
The consignment lock-in period is 90 days. Should you not reduce the price of your item, after 90 days from receiving your item, Shaikha’s closet will automatically reduce the price, hence your payout. Shaikha’s Closet will inform Consignor (client) about new payout amount by email with a minimum of 7 days’ notice. Consignor (client) is required either to proceed to price reduction of own choice or to inform Shaikha’s closet within the 7-day notice period requesting item return. Should Consignor (client) not agree to price reduction past the 7-day notice period, Shaikha’s Closet has the right to sell item at the reduced price and corresponding new Consignor’s (client) payout. The reductions and method are at Shaikha’s Closet’s discretion. The Seller agrees not to question or counter the applied price reduction.
Return of Items:
Shaikha’s Closet will keep the items on the Site/Sites until they sell. If you choose for your items to be returned, the cost of return shipping will be borne by you.
In case of a return for item(s) within the consignment period, a minimum charge of AED 100 per item applies for each item.
Almost all countries apply custom duties on import of items. The Consignor (client) is liable and will be required to pay the customs duty upon delivery of the products. The consignor is liable to check duty rates applicable for his/her country. Please note that custom duties are applicable on return of items and are to be borne by the Consignor (client).
Shaikha’s Closet reserves the right to purchase the item and pay you the requested price upon request to return the item.
If the item you have submitted is proved to be inauthentic or in unsellable condition, Shaikha’s Closet will contact you to arrange a return for your item. If Shaikha’s closet is unable to establish contact with you for 3 months, the item will be discarded.
Counterfeit Items:
For items that are not accepted after quality check, Shaikha’s Closet will contact you to arrange a return. If Shaikha’s Closet is unable to establish contact with you for 3 months, the item will be discarded.
In the case of inauthentic items, Shaikha’s closet will charge an authentication fee of AED 100 per item at the time of return.
Shaikha’s Closet will not bear the charges nor arrangement for shipping back inauthentic or unsaleable items.
Sale of Consigned Merchandise:
· Shaikha’s Closet agrees to photograph and write copyright materials for the consigned merchandise and list it for sale on the Site/Sites or other platforms of choice (third party sites of choice). The merchandise may also be listed for sale on other platforms like eBay by Shaikha’s Closet, or displayed at any associated events for sale.
· Shaikha’s Closet guarantees authenticity of every item offered for sale. Therefore, you warrant the consigned merchandise to be authentic. In the event where we determine the merchandise to be counterfeit, you agree to pay back any payout for the item, authentication and shipping fees for return of item.
· You warrant that you are in legal possession of the consigned merchandise and therefore proof of identification will be required upon collection of selected items in compliance with the provision of the Crime Investigation Department.
· Shaikha’s Closet will make every attempt to obtain the highest possible selling price for the consigned merchandise but shall have full control on pricing the item. No manifested objection is considered as consent.
· If needed Shaikha’s Closet will clean the item before sale. Shaikha’s Closet will bear the cost of cleaning unless the item is recalled during the lock-up period. In case the item/items was or were recalled during the lock-up period, the seller (client) agrees to pay any associated cleaning costs that were incurred by Shaikha’s Closet in addition to the fees imposed upon recalling the item/items. This includes stain removal, color restoration or polishing. Shaikha’s Closet reserves the right to decline merchandise for consignment at their discretion.
· Shaikha’s Closet will take care of cleaning in order to guarantee items are sold in their best conditions of cleanliness and hygiene.
Loss or Damage:
Upon delivery, Shaikha’s closet shall maintain adequate insurance coverage for the consigned merchandise including risks of fire, flood, theft, and damage.
All risk of loss or damage to the merchandise in transit up till the item is inspected by Shaikha’s Closet shall be borne by Consignor (client). If the condition of the item is revaluated to be poorer than earlier estimate, Shaikha’s Closet deserves the right to reduce the payout amount for the item.
